Re Mortgage With CCJs – UK Help & Advice
Are you having CCJs while living in UK? CCJs or County Court Judgments are judgments for debt in the county courts. CCJ will appear in the UK bad credit if it is not paid in 30 days. The judgment will still appear in the register if you make the payment after the 30 days.
Note: If you experience the payment after the mentioned days, you may have a bad credit when you want to apply another mortgage. But the good news is, many lenders can still give their services if you possess CCJs.
You still can go to any creditors if you want to re-mortgage while having CCJs. They are able to take legal action in recovering debts to the County Court. If your debts are up to £5,000 it will be called ‘small claims track’ and you don’t have to go to court for hearing. If your debts are up to £15,000 it is called ‘fast claims track’ that goes for a day in the trial and the cost recoverable is limited. For any other cases, it is called ‘multi-track claim’. Any person, firm, partner, company, or trustee can proceed within the County Court. You can appeal to the Court of Appeal if you don’t agree with the judgment.
A judgement of a County Court may be insist in a number of ways:
(1) Appointment of a receiver.
(2) Earnings order attachment making deductions from the debtor’s earnings and paying them to the county court.
(3) Warrant of execution issued by the district judge against the debtor’s goods which can then be seized.
(4) A 3rd party garnishee ordering payment to the creditor the debt he owes to the debtors.
(5) A charging order imposing a charge on any such property of the debtor as may be specified in the order.
